Bangladesh Blasts

Panic gripped Bangladesh following the series of time-bomb explosions in all the district headquarters except Munshiganj that left at least two people killed and more than 300 others injured on Wednesday.

Bombers under the letterhead of outlawed Jama’atul Mujahideen Bangladesh (JMB) spread leaflets during serial bombings across the country yesterday with a demand for establishing Islamic rule, failing of which they will go for counter-offensive against the authorities.

I am summarizing from the Bangla text above. It is very worth reading to understand the agenda of these terrorists in general.

It is in several sections. First it is addressed to Muslim’s in Bangladesh. Then it addresses the government, then the senators in the ruling party and opposition followed by government officials and judges.

Finally the Muslims of the world are addressed.

They also have warning for Pakistan President Pervez Musarraf and other rulers following Bush and Blair.

It starts with extensive preaching from Quran which I will skip for brevity.

They state from their scriptures that in Muslim land there can only be rule of Allah (Shariat Law AFAIK).

They lament that despite Bangladesh having 90% Muslim population it is not an Islamic nation (and governed by Shariat). Additionally they lament that everywhere in Bangladesh from Districts to Capital, from smaller to larger courts of law the constitution followed is made by man and not by Allah.

They say that their constitution has been created by (knowledgable) sinners. They state that the makers of the constitution have effectively thrown a challenge to Allah by not following the law of Quran.

Hence they state that their country is ruled by Anti-God forces.

So they do not accept their current system and government. They follow this with extensive justifications from their scriptures. Their subsequent letters to other bodies in Bangladesh are along the same lines and are not worth detailing.

Then they address the Muslims of the world.

They state that US President Bush is the biggest terrorist in the world. They further state that he is terrorising by attacking innocent Muslims and forcing non-Islamic constitution upon Islamic nations in an effort to deprive them of their “Iman”.

Literally iman means ‘to know a person to be perfect and truthful and to have faith in him.’ In Islam, ‘iman’ means to believe the fact that Rasulullah (sall-Allahu ta’ala ‘alaihi wa sallam) is Allahu ta’ala’s Prophet; that he is the Nabi, the Messenger chosen by Him, and to say this with the heart; and to believe in brief what he transmitted briefly and to believe in detail what he transmitted in detail from Allahu ta’ala; and to say the Kalimat ash-shahada whenever possible.

They state that by establishing democracy worldwide Bush wants to bring the world under his control through “New World Order”.

They state that the soldiers of Allah will not allow that to happen and they will also not allow the establishment of democracy. They think that democracy is the main weapon of “the evil force”, the same force which arrests the Mujahedi’s following the way of Allah and calls the people-who-bear-arms-for-establishing-Allah’s-law as terrorists.

So they call upon the Muslims of the world to establish the rule of Islam in all islamic countries through armed Jihad.

Finally they warn Musharraf and similar rulers who follow the way of Bush and Blair.

They call Musharraf - Kafer, which means non-believer, and warns him not to act on behalf of Bush (or act as agent of Bush). They state that Muslims worldwide are waking up. They state that if the torture against Muslim’s are not stopped then such rulers will not be safe anywhere in the world. They end with an warning to “anti-islam” NGO’s.

The leaflet in question was signed by Jama Atul Mujahedin Bangladesh.

The scan is not very clear so I couldn’t properly read few words even with magnification. Also several Urdu words were used.

This summarization was based on my thorough knowledge of Bengali/Bangla but very limited knowledge of Urdu. So despite my best efforts few errors may have crept in.

The Problems of Industries in Bangladesh

After independent, Bangladesh Nationals set up Industries investing family resources ,using Innovative Technology as self earner, to achieve economic freedom & for creation of jobs for millions of unemployed within permissible limit of Government
Government also started to help these fast growing PRIVATE SECTOR INDUSTRIES AS IMPORT SUBSITUTES and for EXPORT utilizing the fund / grants received from International Donor Agencies and distributed through different Banks from 1979
But the Owners of these Industries became helpless victims of continuous harassment, conspiracy, willful negligence’s, malice activities and anti- propaganda including fraudulent activities of Bank Officials and of their controlling authority due to lack of any effective laws to protect the owner of Private Industries of Bangladesh till date.

All these have been done willfully and in pre planed way to jeopardize the Government decision to advance the private sector & to terrorize the Owners of Industries of Private Sector finally to occupy the mortgage properties of the owner of the Industries of Private Sector. In this way large number of Industries have been destroyed in Bangladesh so far.
Over and above due to illiteracy, ignorance and extreme poverty of Bangladesh Citizen - Bank Officials managed the concerned authority to enact black / oppressive laws to hide out their offences and will full negligence’s .
In 1992 & 1996 Government of Bangladesh identified and registered many Industries as SICK INDUSTRIES declaring not as Defaulter of Bank Loan but victims of Violation of Contract , Negligence , Fraudulent Activities or Malpractices of Bank Officials .due to lack of existence of accountability or suitable law to check such offences yet.

THE HELPLESS OWNERS OF INDUSTRIES ARE LOOKING FOR JUSTICE, BUT THE DOOR OF JUSTICE ARE TOTALLY CLOSED due to enactment of ARTHA RIN ADALAT ACT ( Bank Loan Recovery Act ) of 2003 & such other laws.
And Bankruptcy Acts of 1997 deprived the Owners of Industries of basic right & justice like those of Colonial Period WHEN THE HANDS OF THE PRODUCER AND TECHNICIAN OF MOSLIN FABRICS ( which were only produced in Bengal of undivided INDIA) WERE CUT DOWN SO AS TO STOP PRODUCTION OF FINEST FABRICS ( MUSLIN FABRICS ) BY BENGALI TECHNICIAN & PRODUCER .
It is also heard that about 60 to 70 % of outstanding defaulted Bank Loan are lying with Nationalized / State Sector and less then 10 % are with Small and Medium Size Industries of Private Sector and Bank Official can explain well about the remaining of the Loan Amount.

THE LAW OF TORTS ARE MOST COMMON LAW,BUT UNFORTUNATELY APPLICATION OR PRACTICING OF TORT LAW ARE NOT ALLOWED IN BANGLADESH YET.

Due to which BANGLADESH HAS BECOME A HEAVEN OF REPRESSION / EXPLOITATION forcing to increase Poverty level, Lawlessness, Social Injustice ,Restlessness & , Insecurity for life and Properties of citizen.

The Owners of Industries are not allowed to claim any set –off or compensation on the suit filed by BANK or other money lending Agencies for Loan Recovery under Artha. Rin Act for violation of contract, negligence, malpractices or fraudulent activities of Bank officials or others .
Compensation suits even filed by the Owner of industries against Bank or Money Lending Agencies are not allowed to run simultaneously or in parallel way so as to prevent major abuse of law
AS A RESULT NUMBER OF SICK INDUSTRIES are increasing in every year due to lack of accountability of Officials of Banks including their controlling authority.
OVER AND ABOVE TOTAL INDEMNITY OF LAW HAVE BEEN GIVEN TO THE BANK OFFICIALS AND OTHER LOAN GIVING AGENCIES so as to hide out high profile malpractices and corruptions as per opinion of Expert Personals..
The Owner of Industries of Private Sector or any Borrower have no Legal Right to protect themselves from the oppression of Bank Officials / Lending Agencies & their controlling authority.

On the contrary in our neighboring countries there are laws like as “DEBT RECOVERY TRIBUNALS (DRT)” FOR BANK LOAN RECOVERY where the Owner of Industries or Borrowers are allowed to claim Set off or claim compensation in same suit. or can run compensation suit simultaneously applying “ TORT LAW ” and are treated by court equally to ensure fair judgment .

But in BANGLADESH Owner of Industries or Borrowers of Bank Loan are completely deprived of any of such opportunity WHICH ARE MOST CONTRADICTORY TO THE HUMAN RIGHT CHARTER OF U N O.
And conflicting to the constitution of Bangladesh also.
These are direct barrier for HONEST INVESTOR or ENTERPRENEUR OF INDUSTRIES and most conflicting to GOVERNMENT DESIRED PRONOUNCEMENT OF DIGITAL BANGLADESH AND FREE ECONOMY .
Owner of Industries or Borrowers of Bank loans are completely deprived of any type of JUSCTICE
People are also facing another type of repression UNDER CERTIFICATE CASE for realization of Government Taxes . small loan from FARMERS & WEAVERS etc ,
Nothing can be raised against the proceedings, or order or Decree of Artha Rin Court to Higher Court without Payment of 50 % of the suit value or Decreetal Amount as such no one can go for appeal to the higher court yet.
The door of justice as a whole are closed denying right of Owners of Industries or Borrower as per Sections 12, 18(2) & (3),19, 20,21,33, 34,40,41,42,44, 47 and 50 of Artha Rin Act.

These Sections are conflicting with ARTICLE 8, 15, 26, AND 27 of CONSTITUTION. OF BANGLADESH.
Now it has become imperative to draw the attention of concern Authority of Bangladesh Government including Patriot Political Leader , Intellectual Persons, Leading Member of Civil Society , Civil Servant , and INTERNATIONAL COMMUNITY TO VERYFY the above laws and come forward to ensure EQUAL RIGHT of JUSTICE as these laws are more worst then Colonial laws of British Regime.

We would also request all concern including INTERNATIONAL COMMUNITITY for Circulating this message among Members , Partners or in News Bulletins, in Printed or Electronic News Media.
And also among all organizations working for suffering peoples to PREVENT LEGAL ABUSE and OPPRESSIVE LAWS and Human Right Organization to consider the following :

1-. To amend the above laws allowing Owners of Industries or borrowers equal right for claiming SET OFF or COMPENSATIONS for Negligence , Violation of Contract , Fraudulent or Malice Activities.

2- Considering the heavy Loss / Damages of Government Registered, Examined and Identified SICK INDUSTRIES of 1992 & 1996 it has become imperative to save the innocent owner by allowing 100 % weaver of all outstanding Bank liabilities withdrawing all Suits unconditionally and return back the deeds and related paper of mortgage properties now lying with bank custody.
3- The Existing System of Mortgage of Landed Properties as security or Co - Lateral Securities need to be completely abolished to prevent ever growing corruption, malpractices and fraudulent activities in Banking Sector of Bangladesh.
4- That concerned authority shall amend or omit Sections 12, 18(2) & 18(3), 19,20,21,33, 34,40,41,42,44,47 and 50 of Artha Rin Acts including Sections 28 ( Kha) of Banking Company Act to create Equal Opportunity / right for the end of JUSTICE.
5- The existing ARTHA RIN ACT of 1993 and Bankruptcy Act now are tarnishing hope of democracy , fair justice and the status of Judiciary as a whole
6- Also to take immediate steps to abolish the system of CERTIFICATE CASE which are nothing but abuse of LAW and worst one like that of COLONIAL RULE similar to Artha Rin Act of 2003..
