“What if I am tortured by my daughter-in-law” - Suicide note

“If a woman is tortured, the first thing police do is arrest her in-laws, even though they are elderly. What if I am tortured by my daughter-in-law? All 498A(a section that deals with physical and mental torture of women) does is put people like us behind bars, it will never put my daughter-in-law behind bars.
Police should look into this discrepancy and if need be change the law, for I am ending my life unable to bear the torture meted out to me by my daughter-in-law…”

This suicide note was on Thursday from an Alipore (Kolkata, India) house where 64 year-old Ranjit Chakraborty hanged himself to death from from his bathroom shower.

Chakraborty, a retired employee of a multi-national company, worked hard till the day he died.
Police conducted a preliminary enquiry and slapped charges of abetting suicide against Chakraborty’s daughter-in-law Litu and his only son Partha. Both were arrested. The police action came not just on the basis of the suicide note, but also after an inquiry in the locality.

Police suspect Partha and Litu had their eyes on their parent’s property and were hence ill-treating their parents.

I felt thoroughly horrified after reading this article. How much low can a woman sink for money? Where is the trust , the respect for the elderly? Such people make me sick to my core.

And yes the law is unfairly tilted towards women in India. If any wife complains of torture by his husband or in-laws, immediately police arrests them, without even preliminary investigation or legal recourse. You are literally at the mercy of your daughter-in-law. And recently quite a few daughter-in-laws have decided to take advantage of the situation.

And what about me….I am being tortured by my brother’s wife everytime I visit the courts as an accused of a false 498 A case….

I am also a woman and I also need protection. Will this DV Law help me and protect me from her?…Why not?…Just because I have a brother and he got married?……

She is the woman who used a 498 A as weapon for extortion. She got what she wanted, and we faced mental, physical harassment and will even have to give her money on the name of maintenance which she will again use against us!!!!!!!!

Statistics suggest that Gokul and Sohail are just the tip of the
iceberg.

*In 2004, 58,319 dowry cases were registered

*1,34,757 men were arrested

*47,828 cases have reached the chargesheet stage

*10,491dowry cases were not chargesheeted as they were based on
frivolous ground.

*However, 5,739 men have been convicted but more than four
times that number have been acquitted (24,127)

The controversial section not only covers dowry, but a wide
spectrum of incidents including cruelty, causing injury and danger to mental or
physical health.

It is this all consuming nature of the law that has legal
experts worried.

Says advocate Dipesh Mehta, “In metro cities complaints like
this are usually filed by women with the intention to harass the husbands. I am
of the view that there should be some change in the provision of section
498A.”

Respected Sir/Madam,

We appreciate and understand your intention to wards improve the Indian Society .Few years back until We faced the reality with the situation and introduce the IPC498a ( Non bailable , non compoundable offence ) which is worse than TADA or POTA, we never consider the effect of the misuse of the same and how this will spoil the basic foundation of institution of marriage of Indian Society. Seating on fence one will feel the same situation. With all our sincere respect to all of you, we request one of you to go the court, check with lawyer and judge. They will tell the real stats and misuse of act and abuse to age old mothers, sisters (including pregnant), father and husbands.

During a chat on Indiatimes, Renuka Chaudhary gave some arguments in favour of DV and 498a. Here are my remarks on that:

Argument1:
A lot of them said “humko marvadi”, you’ve killed us, finished us.
But a lot of women have emailed and written and said “you are our
hero,supergirl Renuka” and all that. But what was most wonderful was
that a lot of senior men and a lot of young people have come forward
and said “I’m so glad you brought it. I wouldn’t accept it if my son
went around slapping a woman”. So there is a beginning…

remark: Has Renuka Chaudhary really asked about the mother or sister
of a victim? Can they also hail Renuka Chaudhary as a HERO? Being a
feminist hero,whether Renuka Chaudhary has concerns over Mental pain
afflicted to such women?

Argument2:
I am quite amazed at the hypocrisy of our society. There is an adult
man and an adult woman. I have no role in that. By law they are
consenting adults. So if voluntarily they are going to live
together, does it mean that the man is entitled to beat her up or
burn her or use her because he is not married to him?

Remark:
Well.A man is living with a woman. The man pays some amount to the
woman. As being an adult the woman is free to live with other men
too. They may be paying to her. This is perfectly OK.Then who are
prostitudes? Why are you putting them into jails, snatching their
earnings.

Argument3:
If not eradicate, it will at least help set directions for men to
behave. A lot of men don’t realise that what they do naturally is
actually not acceptable as societal norms. So we will be able to
give direction. We have set up a framework and the children of the
future will grow up in an environment where they see parents respect
each other. In any case, you didn’t need the law to do this. This is
part of the vows you took when you got married and you haven’t
implemented that. So sometimes we have to step in to play teacher.

Remark:
Respecting each other is not necessary as the wife can do anything.
How efficient teacher Renuka is? If a teacher teaches with such a
law such a law, then why to teach men only? Even if you take an
assumption that there is no physical abuse of men by women, no one
can be sure that there are no oher abuses like verbal and Emotional.
Renuka should know about the women who compell their husband to keep
himself allof from their parents. Is it not an emotional abuse?

Argument4:
How do you say 498 A is draconian? Is it draconian that women are
burning? That even pregnant women have not been spared? That there
is so much domestic violence that the whole psyche of an Indian
woman goes for a six? The children grow up witnessing this and
believing it is right for them to beat up some other human being. It
is not even so much as men and women as one human being to another.
It is completely inhuman to behave like that.Yes, some women have
misused 498 A, but neither has that misuse been a deterrent for
women being burnt. It has also not stopped the dowry demands.So if
some women somewhere do it, does that mean I don’t bring a law at
all?

Remark:
Everything she confessed. I don’t need to put a remark.

Argument5:
Oh there are plenty, even advanced economies like USA have this. We
looked at them but what was necessary was that we look at ourselves.
India can’t copy anyone else because of the complexities — the
multiple religions, hundreds of languages, the gap between the
educated and the illiterate, superstitions — to bring a law to say
one size fits all is really quite complex.

Remark:
An unfalliable rule-No need to evolve a law from within overselve.
Look for advanced economies like USA and others. Take similar laws
and remove every thing which talks of gender equality(in real sense)
and supports men. This step is quite necessary for being a FEMINIST
HERO. Renuka followedd it exactly and you see- she is a hero.
